The claim

Israel's military campaign in Gaza after October 7, 2023 constitutes a deliberate genocide — an intentional state campaign to destroy the Palestinian people as such.

A framing whose rhetorical genealogy in anti-Jewish propaganda is documented, while underlying policy questions remain legitimately debated.

Historical context

The charge appeared almost immediately after October 7: Raz Segal's 'A Textbook Case of Genocide' (Jewish Currents, Oct 13, 2023) and an 800-signatory scholars' warning of 'potential genocide' (Oct 15) preceded Israel's Oct 27 ground invasion; UN official Craig Mokhiber's 'textbook case of genocide' resignation letter followed Oct 28. South Africa filed at the ICJ on Dec 29, 2023; the court issued provisional-measures orders on Jan 26, Mar 28, and May 24, 2024. Amnesty International concluded genocide on Dec 5, 2024; the International Association of Genocide Scholars passed a genocide resolution Sept 1, 2025 (86% in favor, on a low member turnout that critics flagged); the UN Commission of Inquiry found genocide Sept 16, 2025. A counter-literature ran in parallel: John Spencer's urban-warfare analyses (2024–25), the Henry Jackson Society's casualty-data critique (Dec 2024), Washington Institute analyses of Gaza Health Ministry data, and Goda's history of the charge's pre-2023 lineage. A ceasefire began Oct 10, 2025; the ICJ merits case runs to the end of the decade.

The debunking

The counter-case rests on three pillars. (1) Urban-warfare baselines: John Spencer (West Point MWI) documents IDF mitigation — millions of evacuation warnings by call/text/leaflet, pauses, aid facilitation — and argues even Hamas-sourced figures yield a civilian-to-combatant ratio (~1.5:1 or lower) below Mosul (~2.5:1) and far below the ~9:1 typical of modern urban war; a state with Israel's firepower intending extermination would have produced casualties orders of magnitude higher. (2) Casualty data: Andrew Fox's HJS report and Gabriel Epstein's Washington Institute series document duplicate and erroneous Gaza MoH entries, inclusion of natural and pre-war deaths, no combatant/civilian distinction, undercounted fighting-age men, and thousands of names quietly delisted in 2025 revisions. (3) Law: genocide requires dolus specialis — destruction of the group 'as such' must be the only reasonable inference; legal critics argue documented mitigation defeats that inference, Amnesty's loosened 'reasonable inference' standard drew scholarly criticism, and the ICJ's 2024 provisional measures were expressly not genocide findings — ex-president Joan Donoghue publicly clarified the court found plausible rights, not 'plausible genocide.' The IAGS resolution (passed on a low member turnout, with open membership and Hamas-sourced footnotes) and the UN COI report drew serious methodological criticism. The legitimate-debate zone is wide: the ICJ case is pending, major institutions and serious scholars — including Holocaust historian Omer Bartov, who initially rejected the label — reached the genocide conclusion, the counter-case is itself contested, and arguing either side is not antisemitic.
